People often come into my office and say, ” My bank account has been frozen. What do I do?” Frequently, they also say, ” I don’t even recognize the name of the company who froze my bank account!”

A lot of times you have no reason to recognize the name. Debts gets sold two, three, four times. Sometimes, there’s also mistakes in the identity of the person whom they’re trying to collect.

People often ask, “How long is it going to take to get my bank account un-frozen?”

The answer is; There’s no fixed rule on that. The sooner you get to a lawyer who knows what they’re doing the sooner they can get into court to try to get the bank account un-frozen. A lot of it is in the hands of the Court and the judge. So, you don’t know if it’s going to take one, two, three, four months to get un-frozen. A lot of it’s going to depend on how quickly you get to the lawyer, how quickly the lawyer can get to the court, and how soon you can get your hands on a court file, whether it’s from the court or another lawyer. You’ve really got to move on this stuff. The sooner you get the ball rolling, the sooner you contact an experienced lawyer, the sooner you can get a copy of your court file, the sooner you can move things along.

When your bank account is frozen it’s stressful. It can lead to bounced rent checks and messed up credit reports. It can cause a lot of trouble. These are debts you had no idea were out there.
