In New York, once a creditor has filed a lawsuit against you, they have 120 days to serve you with a copy of the Summons & Complaint. The Summons and Complaint will tell you where the case was filed, why the creditor is suing you, how much they think they are owed, and how much time you have to respond.

How much time you have to respond to the Summons and Complaint, or in legal terms, file an Answer, depends on how you were served and the Court in which the lawsuit was filed. This information is explained at the bottom of the Summons.

Your Answer to the Summons must be written and served properly to make sure that it is recorded so a default judgment isn’t entered against you.

You should never file an Answer to a Summons and Complaint yourself. You run the risk of making mistakes that can lead to a default judgment against you. Once a default judgment has been entered against you, things get much more complicated and difficult to resolve.
